Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") form a binding agreement between you and StickerMe AI("we", "us", "our") governing your access to and use of our sticker generation website and related services (the "Service"). By accessing the Service, placing an order, or clicking to accept these Terms, you confirm that you have read, understood and agree to be bound by them. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Service and to make a purchase. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Description of the Service

For a one time payment of $9.95 you receive 16 AI generated sticker images created from the photo and prompt you provide, delivered as a ZIP archive and a sticker sheet. The Service is provided for entertainment and personal expression purposes. We may modify, suspend or discontinue any part of the Service, including pricing, output count or available styles, at any time, provided that orders already placed and paid for are honored or refunded in accordance with these Terms.

4. Account and order information

You are responsible for providing accurate information when placing an order, including a valid email address if you wish to receive your receipt and download link by email. You are responsible for keeping your unique results link confidential, as it is the primary means of accessing your order.

5. Acceptable use

By using the Service you agree that you will not, and will not attempt to:

• Upload a photo of any person without owning the rights to that photo or without permission from the person shown, or from a parent or legal guardian if the person shown is a minor.
• Use the Service to impersonate, harass, defame, bully or target any individual or group.
• Use the Service, or the content it generates, for fraud, scams, political disinformation, deceptive advertising, or any other misleading purpose.
• Upload or attempt to generate content involving minors in inappropriate, sexualized or exploitative contexts.
• Upload or attempt to generate sexual, hateful, violent, or otherwise unlawful content.
• Attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service, its infrastructure, or other users' data.
• Use automated means, including bots or scrapers, to access the Service other than through publicly supported interfaces.

We may refuse, cancel or reverse any order, and remove any generated content, that we reasonably believe breaches these Terms, without liability to you, and without prejudice to any other remedies available to us. Report suspected abuse through our contact form.

6. AI generated output

Stickers are stylised, AI generated cartoon interpretations of the photo and prompt you provide, and are not photographic likenesses. Results are produced by third party AI models and may vary between generations, even from identical or similar inputs. We do not guarantee any particular degree of resemblance, accuracy, artistic style, or adherence to your prompt, and output may occasionally include unexpected, inaccurate or unintended elements.

7. Ownership and license

You retain all rights to the photo you upload. Subject to your compliance with these Terms and full payment, we grant you a worldwide, non-exclusive, perpetual license to use, reproduce and display your generated stickers for personal and commercial purposes. This license does not extend to any underlying AI model, template, or system used to produce the stickers, which remain our property or that of our licensors. You may not claim exclusive ownership over the underlying AI technology or represent that you developed it.

8. Pricing and payment

All prices are displayed prior to checkout and are payable in full at the time of order through our third party payment processor. We do not store your full payment card details. Prices may change at any time, but changes will not affect orders already placed and paid for.

9. Refunds and cancellations

If generation fails due to a technical error on our side, you may retry free of charge. If we are still unable to deliver a working sticker pack after a reasonable number of attempts, contact us through the contact form and we will issue a refund. Because the Service delivers digital content that begins generating immediately upon order, and subject to any mandatory consumer rights that cannot be excluded under applicable law, we do not otherwise offer refunds for dissatisfaction with the artistic style or outcome of successfully delivered stickers.

10. Intellectual property of the Service

The Service, including its software, design, branding, text and underlying technology (excluding your uploaded photo and generated stickers), is owned by StickerMe AI or our licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos or branding without our prior written consent.

11. Third party services

The Service relies on third party providers, including for AI image processing and payment handling. We are not responsible for outages, errors, delays or data loss caused by these providers, although we take reasonable steps to select reputable partners and to remedy issues within our control.

12. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or free of errors or defects, or that any defects will be corrected.

13. Limitation of liability

To the maximum extent permitted by applicable law, StickerMe AI, its owners, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to loss of profits, revenue, data, goodwill or business opportunity, arising out of or related to your use of, or inability to use, the Service, whether based in contract, tort, strict liability or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability for any and all claims arising out of or relating to a given order shall not exceed the amount actually paid by you for that order.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for fraud or gross negligence, death or personal injury caused by negligence, or any statutory rights you may have as a consumer under applicable consumer protection law.

14. Indemnification

You agree to indemnify, defend and hold harmless StickerMe AI, its owners, employees and subcontractors from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your use of the Service, or the material you upload, including any claim that your uploaded photo infringes the rights of a third party.

15. Force majeure

We are not liable for any delay or failure to perform any obligation under these Terms resulting from causes beyond our reasonable control, including but not limited to outages at third party providers, natural disasters, acts of government, labor disputes, or general telecommunications or internet failures.

16. Suspension and termination

We may suspend or terminate your access to the Service, at our reasonable discretion, if we believe you have breached these Terms, engaged in fraudulent or abusive behavior, or posed a risk to the Service or other users. Provisions of these Terms that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnification and governing law, shall survive.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes in the Service or applicable legal requirements. The "Updated" date at the top of this page reflects the date of the latest revision. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If changes are material, we will take reasonable steps to bring them to your attention.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StickerMe AI regarding the Service, and supersede any prior agreements or understandings, whether written or oral, relating to its subject matter.

20. Governing law and dispute resolution

These Terms are governed by the laws of Sweden, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the competent courts of Sweden, with the Stockholm District Court as court of first instance, unless mandatory law grants you the right to bring proceedings in the courts of your country of residence.
